Aviatrix Acceptable Use Policy
This Acceptable Use Policy (“AUP”) governs use of Aviatrix System, Inc.’s and its affiliates’ (collectively, “Aviatrix”) software, online services, applications, websites, and any related downloadable materials made available by Aviatrix for use therewith (collectively, the “Aviatrix Products”). “You” and “Your” mean the “Customer” individual or legal entity accessing and using the Aviatrix Products under an agreement with Aviatrix, and any users granted such access and use rights by Customer. Terms not otherwise defined in this AUP will have the meaning set forth in the Master Software and Services Agreement, found at https://aviatrix.com/terms-of-use/cloud, or the agreement between You and Aviatrix governing Your use of the applicable Aviatrix Products (“Agreement”).
You agree not to:
- Interfere or attempt to interfere in any manner with the functionality or proper working of the Aviatrix Products;
- Breach or otherwise bypass any security or authentication measures of the Aviatrix Products, or access or use Aviatrix Products which Aviatrix has not authorized You to access or use;
- Transmit to or through the Aviatrix Products any infringing, inappropriate, unlawful or tortious material or content, or any viruses, malware, malicious code, or any other routine, device or other undisclosed feature that either interferes with or otherwise harms or provides unauthorized access or causes unauthorized modifications to the Aviatrix Products;
- Use any robot, spider, data scraping or extraction tool, or similar mechanism in the Aviatrix Products;
- Copy, modify, or create derivative works of the Aviatrix Products without authorization from Aviatrix, or access, use, or otherwise exploit the Aviatrix Products for purposes of disparaging Aviatrix or the Aviatrix Products, including but not limited to benchmarking, monitoring availability, performance, or functionality, or conducting competitive analysis;
- Publicly disseminate information regarding the performance of the Aviatrix Products such as benchmarking results; or
- Attempt to disable or block the transmission of Usage Data to Aviatrix;
Location of Access
You are responsible for securing, using, and monitoring an internet connection, which may include a VPN, that is compliant with laws and regulations of the jurisdiction from which You access Aviatrix Products.
Violations of this AUP
In addition to any other remedies that may be available, Aviatrix reserves the right, in its sole discretion, to take any remedial action it deems necessary, including immediately suspending or terminating Your account, to prevent disruption of the Aviatrix Products or to protect the rights and safety of individuals, customers, or Aviatrix.
Revisions to this AUP
Aviatrix may revise this AUP from time to time to reflect changes to technologies, industry practices, regulatory requirements, or as Aviatrix may deem necessary. Any such revision will be effective immediately unless our Agreement states otherwise. You may request notifications of changes to this AUP via [email protected].
